Although the firm maintains a diverse practice, the most substantial
area of its practice involves real estate and real estate-related
litigation. The firm's clients include a number of the area’s
prominent real estate developers, commercial and residential landlords,
construction companies, lenders, real estate management companies,
liability insurance carriers, and community associations.
The firm has also been engaged on a number of occasions to act as local Massachusetts counsel for out-of-state lenders and real estate developers, working in cooperation with attorneys and law firms from other areas of the country. Marcus, Errico, Emmer & Brooks, P.C. also maintains a substantial practice in the area of community association law. This field of law involves the representation of owner organizations such as condominium boards, homeowners' associations, cooperative corporations and similar entities. At present, the firm represents over 2,700 such associations, constituting the largest practice in this field in New England, and one of the largest in the nation. The principals (partners) of the firm have concentrated in this area of law for as many as 20 years and are among the leaders in the industry, both in New England and on the national level. Three of our attorneys, Stephen M. Marcus, V. Douglas Errico and Seth Emmer, have been admitted to the Community Association Institute's national "College of Community Association Lawyers". Although matters are
generally handled on an hourly fee basis, the firm is open to discussion of
other fee arrangements under appropriate circumstances, including flat fees
for certain services, as well as a "blended rate" structure, whereby all
attorneys and paralegals are billed at the same hourly rate in connection
with a matter or case.
