MEEB SECURES SETTLEMENT FOR ASSOCIATION’S CONSTRUCTION DEFECT CLAIM
Marcus Errico Emmer & Brooks, P.C. is pleased to announce the recovery of nearly $600,000 on behalf of a small South Shore condominium association in a construction defect and water damage dispute against its developer. The association had long been burdened by serious construction defects and resulting water damage that the developer had failed to adequately address. Nearly three years ago, the association presented the developer with a pre-suit demand of $300,000 — a figure the developer declined to meaningfully engage with at the time. Unwilling to leave the association without recourse, litigation partner Seth Barnett filed suit to protect the association's interests and hold the developer accountable.
Once litigation commenced, the developer moved quickly to pursue mediation — a posture that stood in sharp contrast to its earlier indifference. Through skilled negotiation and a thorough command of the underlying liability and damages issues, MEEB ultimately secured a settlement of nearly $600,000, representing nearly double the association's original pre-suit demand. The result delivered meaningful relief to the unit owners who had been living with the consequences of the developer's deficient work and vindicated the association's decision to pursue its legal remedies rather than accept silence as an answer.
This outcome reflects the firm's longstanding commitment to advocating aggressively for condominium associations and their unit owners when developers fail to stand behind their work. Construction defect claims require careful preparation, a clear-eyed assessment of damages, and the willingness to litigate when necessary to bring a responsible party to the table. We congratulate the association's trustees and management on their patience and perseverance throughout this process, and we are proud to have achieved a result that nearly doubled what was originally sought.
